The particularities of mortgage loan regulations

Real estate credit (purchase of a good or carrying out major works) comes under different regulations from that of consumer credit.

We do not therefore speak of a withdrawal period but of a mandatory reflection period of at least 10 days after the loan offer from the credit institution.

The beneficiary cannot formally immediately accept the offer which is valid for 30 days.

  • the borrower and any sureties must return the credit offer with mention of acceptance, after this minimum period of 10 days, by mail, the postmark being taken as proof.

The lender can no longer impose on the borrower his Group Lender Insurance.

  • however, he may refuse individual insurance that does not present a level of guarantee equivalent to his Group Insurance contract.

A standardized information sheet must be given to any person who is offered or who requests insurance aimed at guaranteeing the repayment of a mortgage.

  • For one year, the borrower has the option of replacing the initial insurance contract with another insurance contract with an equivalent level of guarantee.
